Plaintiff Webb, while employed at a lumber mill, was about to drop a 75-pound pine block from an upper floor. He saw J. Greeley McGowin, the defendants’ testator, standing directly below. To prevent the block from striking and killing or seriously injuring McGowin, Webb held onto the block and fell with it, successfully diverting its path. In doing so, Webb sustained severe and permanent injuries, crippling him for life. McGowin was unharmed. In consideration for Webb saving his life and for the injuries Webb sustained, McGowin subsequently promised to pay Webb $15 every two weeks for the remainder of Webb’s life. McGowin honored this agreement for over eight years until his death. After his death, McGowin’s estate discontinued the payments. Webb sued the estate to recover the unpaid installments. The trial court sustained the estate’s demurrer, finding the complaint stated no cause of action because the agreement lacked consideration.
