Case Brief Summary & Legal Analysis

General Brief

tl;dr: Buyers of a defective RV successfully revoked their acceptance. The court found that chronic, unresolved problems like engine overheating substantially impaired the RV’s value to them, justifying revocation even after a significant time had passed while the seller attempted repairs.

Legal Significance: This case establishes the controlling test in Nevada for determining when a good’s nonconformity “substantially impairs its value” under UCC § 2-608, adopting a two-part subjective and objective standard. It also affirms that the time for revocation is tolled during the seller’s repair attempts.

Case Facts & Court Holding

Key Facts & Case Background

Appellants Arthur and Roswitha Waddell purchased a 1996 Coachmen Santara motor home (RV) from respondent L.V.R.V. Inc. (Wheeler’s). The Waddells intended to sell their home and travel the country in the RV for several years. Immediately after taking delivery, they experienced numerous problems, most notably chronic engine overheating that made travel unsafe and unreliable. Over the next 18 months, the Waddells repeatedly returned the RV to Wheeler’s for service. The vehicle spent a total of seven months in Wheeler’s service department, but the dealer was unable to permanently fix the overheating and other issues. After numerous failed repair attempts, the Waddells demanded a full refund. When the dispute could not be resolved, they filed suit seeking to revoke their acceptance of the RV under Nevada’s codification of the Uniform Commercial Code (UCC). The trial court found in favor of the Waddells, allowing revocation. Wheeler’s appealed, arguing the defects did not substantially impair the RV’s value and that the revocation was not timely.
