Hugo Tunkl was admitted to the University of California Los Angeles Medical Center, a nonprofit charitable research hospital. As a condition of admission, he was required to sign a form containing an exculpatory clause. The clause stated that in consideration for the services rendered, the patient released the hospital from “any and all liability for the negligent or wrongful acts or omissions of its employees,” provided the hospital had used due care in selecting them. Tunkl later brought a malpractice action, alleging he was injured by the negligence of two hospital physicians. The parties stipulated that the hospital had exercised due care in selecting its employees. The trial court first submitted the validity of the release to a jury, which found it enforceable. Based on this verdict, the court entered judgment for the hospital. Tunkl’s executrix appealed, arguing the exculpatory clause was void as contrary to public policy.
