He delivered the deed to his attorney, Richard Freedman, with explicit instructions not to record it, stating he would provide further instructions later. Freedman affirmed he would not have recorded the deed without Smith’s subsequent authorization. A few weeks before his death, Smith allegedly asked his nephew to instruct Freedman to record the deed. However, the nephew never communicated this message to Freedman before Smith’s death. After Smith died, Freedman’s office mailed the unrecorded deed to Sargent, who then recorded it.
