Case Brief Summary & Legal Analysis

General Brief

tl;dr: An employer revoked a job offer after the prospective employee quit his prior job in reliance on the offer. The court held that the employee could sue for damages under the doctrine of promissory estoppel, reversing summary judgment for the employer.

Legal Significance: Promissory estoppel can create a cause of action for reliance damages when an offer of at-will employment is revoked before work begins, even though the underlying employment contract would have been terminable at will by either party upon commencement.

Case Facts & Court Holding

Key Facts & Case Background

Bobby Wayne Roberts, while employed by Huthnance Drilling Company, interviewed for an overseas position with Geosource Drilling Services, Inc. Geosource’s representative, Sturm, found Roberts qualified and informed him he was hired. Roberts completed employment paperwork, signed an employment agreement, underwent a physical exam, and surrendered his passport. Sturm, aware that Roberts was currently employed and would need to resign, told Roberts he would be departing for Peru in approximately ten days. In reliance on Geosource’s promise of employment, Roberts terminated his position with Huthnance. Shortly thereafter, Sturm informed Roberts that Geosource was revoking the offer because it had found a more qualified candidate. Roberts sued Geosource for, among other things, detrimental reliance (promissory estoppel). The trial court granted summary judgment in favor of Geosource.
