Case Brief Summary & Legal Analysis

tl;dr: Owners of a worthless lot attempted to abandon it to escape association fees. The court held that real property held with perfect title cannot be legally abandoned, so the owners remained liable for the fees.

Legal Significance: Under Pennsylvania law, an owner cannot abandon real property held in fee simple with perfect title, regardless of their intent or the property’s lack of value. Ownership obligations persist until title is transferred.

Case Facts & Court Holding

Key Facts & Case Background

Appellants, Joseph and Doris MacKenzie, purchased a vacant lot in a development managed by Appellee, Pocono Springs Civic Association. The deed contained a covenant requiring all property owners to pay annual dues to the Association. In 1987, the MacKenzies discovered the lot was unsuitable for an on-lot sewage system, rendering it unbuildable and, in their view, worthless. They subsequently attempted to abandon the property. Their efforts included offering the lot to the Association (which was refused), ceasing payment of property taxes and association fees, and mailing a notarized statement declaring their intent to abandon the property to all interested parties. The county was unsuccessful in selling the lot at a tax sale. The Association sued the MacKenzies to recover unpaid dues. The MacKenzies defended by claiming they had successfully abandoned the property and were no longer owners. The trial court granted summary judgment in favor of the Association.
