Plaintiff Donald Odorizzi, a school teacher, was arrested on criminal charges of homosexual activity. Forty hours later, having had no sleep, he was visited at his apartment by his superiors, the school district superintendent and his principal. They stated they were there to help him and that he should immediately resign. They advised against consulting an attorney, warning that if he did not resign at once, the district would be forced to suspend him and publicize the embarrassing proceedings. However, if he resigned immediately, they assured him the matter would be kept quiet, preserving his chances of finding employment elsewhere. Suffering from severe mental and emotional strain, Odorizzi agreed and signed the resignation. The criminal charges were later dismissed. When the school district refused to reinstate him, Odorizzi filed suit to rescind his resignation, alleging his consent was obtained through duress, fraud, mistake, and undue influence.
