This nonexclusive easement burdened the property by allowing for the construction and maintenance of a dam, the flowage of water, and the permanent or temporary storage of impounded water. The McMurrays, who intended to build residences on the land, sued the Housworths for breach of the warranty of title, specifically the covenant against encumbrances. The trial court granted summary judgment to the Housworths, reasoning that the easement was analogous to a public road easement or zoning regulation, that the McMurrays had constructive notice from the record, and that no eviction had occurred. The McMurrays appealed.
