Ann Johnson and John Zent were in a close personal relationship for nearly a decade but never married and maintained separate residences. As Zent’s health declined from strokes and Alzheimer’s disease, Johnson’s role evolved from a social companion to a caregiver. From 1985 until Zent’s death in 1988, Johnson provided extensive and necessary services, including cooking, cleaning, shopping, administering medication, and assisting with personal hygiene as he became incontinent and confused. Medical evidence corroborated that Zent’s deteriorating condition required such care. After Zent’s death, Johnson filed a claim against his estate for $31,025 for her services. The personal representative denied the claim. During a deposition, Johnson stated she performed the services out of kindness and did not expect to be paid. The trial court found no contract implied in law, concluding that the services were not required and were rendered gratuitously, thus there was no unjust enrichment. Johnson appealed.
