tl;dr: A customer suspected of shoplifting sued a store for false arrest and trespass to chattel. The court found the store had reasonable cause to detain him but that the manner of detention was a jury question, while the brief, harmless search of his truck was not an actionable trespass.
Legal Significance: This case clarifies the application of the shopkeeper’s privilege, holding that while reasonable cause to detain may exist as a matter of law, the reasonableness of the detention’s manner remains a question of fact. It also affirms that trespass to chattel requires actual damages for mere intermeddling.

Case Facts & Court Holding
Key Facts & Case Background
Max Koepnick was stopped in a mall parking lot by two Sears security guards who suspected him of shoplifting a wrench. The guards detained him for approximately 15 minutes until Mesa police arrived. After police arrived, an altercation occurred between Koepnick and an officer. An investigation revealed Koepnick had a receipt for the wrench. A Sears guard and a police officer then searched Koepnick’s truck in the parking lot, finding no stolen items. The entire detention lasted about 45 minutes, with the search taking approximately two minutes. Koepnick was cited for disorderly conduct and released. He sued Sears for false arrest and trespass to chattel. A jury found for Koepnick on both claims, awarding compensatory and punitive damages. The trial court granted Sears’ motion for a new trial on the false arrest claim, finding reasonable cause existed as a matter of law, and granted a judgment notwithstanding the verdict (JNOV) for Sears on the trespass to chattel claim.
Court Holding & Legal Precedent
Issue: Can a merchant be liable for false arrest under the shopkeeper’s privilege when reasonable cause to detain a suspect exists as a matter of law but the manner of detention is disputed, and can the merchant be liable for trespass to chattel for a brief, harmless search of the suspect’s vehicle?
