The Empire State Development Corporation (ESDC), a state agency, sought to exercise its eminent domain power to acquire 17 acres of private commercial property in West Harlem for a major campus expansion by Columbia University, a private, non-profit institution. Petitioners were owners of commercial properties within the designated project area. To justify the taking, ESDC sponsored the project on two alternative grounds under the Urban Development Corporation Act: first, as a “land use improvement project” to eliminate purported urban blight, and second, as a “civic project” to advance education.
