Professor Apostolos K. Kakaes was a tenure-track professor at George Washington University. The University’s Faculty Code, which formed the employment contract, required the University to provide notice of a tenure denial by a specific date. The Code stated that any faculty member “not so notified shall acquire tenure at the end of the term.” The University failed to provide clear, timely notice of its final decision to deny Kakaes tenure. A letter sent before the deadline stated Kakaes would not be granted tenure but also noted that the question of his “ultimate tenuring or termination remains to be resolved,” creating ambiguity.
