The sales agreement included a disclaimer limiting the implied warranty of merchantability to 15 days or 500 miles, as permitted by Arizona statute. Simultaneously, Johnson paid an additional $1,235 for a DaimlerChrysler service contract, which she applied for through Earnhardt. The service contract application, signed by both Johnson and an Earnhardt manager, contained a clause stating Earnhardt would “provide service to [Johnson] in accordance with the provisions of the service contract DaimlerChrysler will issue.” However, the service contract itself defined the parties as only Johnson and DaimlerChrysler.
