Case Brief Summary & Legal Analysis
tl;dr: A landowner was tricked into signing a mineral deed, believing it was an oil lease. The court held the deed was void, but remanded to determine if the landowner’s negligence should prevent him from voiding it against a subsequent innocent purchaser.
Legal Significance: Establishes that while a deed obtained by fraud in the factum is void, the grantor may be estopped from asserting its invalidity against a bona fide purchaser if the grantor was negligent in signing the instrument.

Case Facts & Court Holding
Key Facts & Case Background
Plaintiff Hauck, a farmer, agreed to lease his land for oil and gas to a group represented by D.W. Crawford. During the signing process, which occurred in a car, Crawford’s associate presented multiple documents on a clipboard. The associate misrepresented the nature of the documents, indicating where Hauck should sign and stating that a second signature was for a part of the lease. In reality, Hauck was tricked into signing a mineral deed conveying one-half of his mineral rights to Crawford, in addition to the lease. Hauck did not read the documents and was not given copies. Shortly thereafter, Crawford conveyed the mineral rights to defendants White and Duncan, who were bona fide purchasers for value without notice of the fraud. Upon discovering the deed, Hauck filed an action to quiet title and cancel the deed. The trial court found for Hauck, holding the deed was void due to fraud.
