Case Brief Summary & Legal Analysis

3 min read

tl;dr: A woman who provided information leading to a murderer’s arrest was denied a reward because she was unaware of the offer when she gave the information. The court held that knowledge of an offer is required for acceptance.

Legal Significance: This case establishes the majority rule for unilateral contracts: an offeree cannot accept an offer by performance unless they have knowledge of the offer at the time of performance. It underscores the requirement of mutual assent in contract formation.

Case Facts & Court Holding

Key Facts & Case Background

The Jewish War Veterans of the United States (defendant) offered a $500 reward for information leading to the apprehension and conviction of a murderer. The offer was published in newspapers on June 7. On June 11, police questioned Mary Glover (plaintiff) about the whereabouts of one of the suspects, who was her daughter’s boyfriend. In response to police questioning, Glover provided names and addresses of relatives, which led the police to arrest the suspect on June 13. Glover testified that she first learned of the reward offer on June 12, the day after she had given the police the critical information. She was not actively volunteering information to claim a reward but was merely answering questions posed by law enforcement. When the defendant refused to pay, Glover sued to collect the reward. The trial court directed a verdict for the defendant, and Glover appealed.
