Appellees owned islands within Lake Iamonia, a navigable public waterway. Pursuant to state law, the Game and Fresh Water Fish Commission promulgated a rule prohibiting the use of all motorboats and airboats on the lake during duck hunting season. Due to the lake’s shallow depth and dense vegetation, which was exacerbated by a Commission-managed water drawdown, airboats were the only practical and reasonable means for the appellees to access their island properties. The Commission denied the island owners’ request for a permit to use airboats for ingress and egress. The owners sought an injunction, arguing the rule unconstitutionally deprived them of access to their property.
