In 1936, appellants’ predecessors-in-title (Grimes) leased 191.22 acres of land. The lease permitted the lessee to consolidate the land with adjacent tracts into a unit not exceeding 640 acres. In 1940, the parties executed a ‘Gas Order and Operating Agreement’ that superseded prior agreements and pooled the entire Grimes tract with other lands into a 640.22-acre ‘consolidated area.’ A producing gas well, the Bednorz No. 4, was located on other land within this unit but not on the Grimes tract. Production from this well has been continuous since 1937. The Grimes family accepted royalty payments until 1979. Appellants later sued to declare the lease terminated, arguing the 1940 consolidated unit was invalid because a railroad right-of-way bisected the acreage, rendering the tracts non-contiguous in alleged violation of the lease terms and Railroad Commission rules. They contended that because the unit was improper, production from the Bednorz well could not perpetuate their lease.
