Barry and Sandra Erlich contracted with John Menezes, a general contractor, to build their “dream house.” Shortly after completion, the house suffered from pervasive water leaks. An inspection revealed numerous, severe structural defects, including improperly installed load-bearing walls, inadequately connected roof turrets, and a foundation for a main beam that could only support a fraction of the required load. Menezes’s attempts to repair the defects were invasive and unsuccessful. The Erlichs suffered significant emotional distress, fearing for their safety and the potential collapse of the home. Barry Erlich developed a permanent heart condition, which he attributed to the stress. At trial, the jury found Menezes had breached the contract through negligent construction and awarded the Erlichs the cost of repairs.
