Appellants, the Doners, entered into an oral agreement to purchase a “trio” of ostriches (two females, one male) from the appellees, the Snapps, for $9,000. The Doners subsequently discovered they had received two males and one female, a non-conformity difficult to detect in young birds. After the Snapps refused to exchange one of the males for a female, the Doners sued for breach of contract. Before filing suit, the Doners traded the non-conforming male ostrich for two female chicks. In a deposition, Mr. Doner admitted that at the time of the sale and at the time the breach was discovered, there was little to no difference in value between male and female ostriches. He also testified that in the subsequent trade, he received substitute chicks of “roughly equivalent value.” The Doners sought $15,000 in compensatory damages, based on the appreciated value of a female ostrich at the time of the lawsuit, and damages for lost profits from potential egg production. The trial court granted summary judgment for the Snapps, finding the Doners failed to establish damages.
