Case Brief Summary & Legal Analysis

4 min read

tl;dr: A homeowners’ association successfully enjoined property owners from operating a commercial group home for the elderly, as the court found it violated a private restrictive covenant. The court held that a state statute promoting such homes for zoning purposes did not override the private covenant.

Legal Significance: This case establishes that state statutes expressing public policy for zoning purposes do not, by their own force, invalidate conflicting private restrictive covenants. The distinction between public zoning power and private contractual land use restrictions is maintained.

Case Facts & Court Holding

Key Facts & Case Background

Appellants (the Romriells) purchased a property within the D & M Country Estates subdivision, which was subject to a set of restrictive covenants enforced by the Respondent homeowners’ association (D & M). A key covenant stated, “No more than one dwelling shall be erected on any one lot and all such dwellings shall be limited to not more than two families.” The Romriells planned to convert the existing single-family residence into an eight-bedroom, eight-bath facility to operate as a commercial group home for up to eight unrelated elderly adults. After D & M and the homeowners formally rejected their proposal for an exception to the covenants, the Romriells began remodeling anyway. They argued that Idaho Code §§ 67-6530 and 67-6531, which declare that a group home for eight or fewer elderly persons is a residential use for zoning purposes, rendered the private covenant unenforceable as against public policy. D & M filed suit and obtained a permanent injunction preventing the construction and operation of the group home. The Romriells appealed.

Court Holding & Legal Precedent

Issue: Do state statutes that define a small group home for the elderly as a residential use “for the purposes of local zoning” invalidate a conflicting private restrictive covenant that limits a property’s use to no more than two families?
