Alvina Wagner, a California resident, died in 1942, bequeathing her entire estate, which included real and personal property in California, to four relatives who were nationals and residents of Germany. At the time, the United States was at war with Germany. Six of Wagner’s heirs-at-law, residents of California, challenged the bequest, citing a California statute that conditioned the right of non-resident aliens to inherit on the existence of a reciprocal right for U.S. citizens to inherit in the alien’s country. In 1943, the U.S. Alien Property Custodian, acting under the Trading with the Enemy Act, vested all rights of the German nationals in the estate and filed suit to claim the property. The central legal conflict involved the 1923 Treaty of Friendship, Commerce and Consular Rights with Germany, which contained provisions for inheritance. The case required determining whether the treaty survived the outbreak of war and, if so, whether it preempted the California statute.
