Case Brief Summary & Legal Analysis
tl;dr: An insurer and insured disputed a stolen truck’s value. The court voided the resulting appraisal award because the process, which denied the insured notice and a hearing, was fundamentally unfair, regardless of whether it was formally labeled an “appraisal” or “arbitration.”
Legal Significance: Establishes that even an appraisal process, distinct from formal arbitration, requires fundamental fairness, including notice and an opportunity to be heard when a party requests it, especially when appraisers lack personal knowledge and must rely on external information to determine value.

Case Facts & Court Holding
Key Facts & Case Background
Jack Yother’s insured tractor-truck was stolen. He submitted a proof of loss to his insurer, Casualty Indemnity Exchange (CIE), for the $40,000 policy limit. CIE disputed the value, countering with $35,000, and suggested resolving the dispute via the policy’s “Appraisal” clause, which CIE’s adjuster referred to as “arbitration.” Following the clause, each party appointed an appraiser. Yother’s appraiser was familiar with the truck, but CIE’s was not. The two appraisers failed to agree on a value and selected an umpire. Before the umpire made a decision, both appraisers signed a blank award form and forwarded it to him. The umpire, without consulting either appraiser or the insured and without conducting any hearing, unilaterally entered an award of $36,500. Yother had twice requested an opportunity to appear and present evidence regarding the truck’s value but was denied. The trial court set aside the award, and CIE appealed.
