The Bethurems (Buyers) contracted to purchase a residence from the Hammetts (Sellers). The written agreements contained express covenants warranting that title was “merchantable,” the property complied with all city regulations, and there were “no known defects” except those “readily visible upon inspection.” After the sale, surveys revealed that the house, garage, and fence substantially encroached onto a dedicated city street, which violated a local ordinance. The Buyers sued for rescission based on breach of warranty. The Sellers argued that they had orally informed the Buyers of the encroachment before the contract was signed and that the boundary was marked by strings on a fence, making the defect readily visible. The trial court admitted the Sellers’ testimony regarding the oral disclosure over the Buyers’ parol evidence objection and ruled in favor of the Sellers. The Buyers appealed.
