Plaintiff Karen Bentley, a musician, responded to a notice posted by Defendant Charles Slavik for the sale of an “Auguste Sebastien Philippe Bernardel violin made in 1835.” During their meeting, Slavik orally represented the violin as an authentic Bernardel and presented a certificate of authentication from a deceased appraiser valuing it between $15,000 and $20,000. Relying on these representations, Bentley purchased the violin for $17,500. The bill of sale, signed by Slavik, described the item as “One Bernardel A.S.P. Violin.” The court found that Slavik, who was not a violin merchant, genuinely believed the violin was authentic and did not purposefully misrepresent it. Over a year after the purchase, Bentley learned the violin was not a genuine Bernardel. Expert testimony confirmed the violin was not authentic and valued it at only $2,000 at the time of sale.
