An Oregon resident died intestate, leaving his estate to his sole heirs, who were residents of East Germany. An Oregon statute, Ore. Rev. Stat. § 111.070, provided for the escheat of property claimed by a nonresident alien unless three conditions were met: (1) the alien’s country granted reciprocal inheritance rights to U.S. citizens; (2) U.S. citizens had the right to receive payments from estates in that country; and (3) the foreign heirs could receive the proceeds “without confiscation” by their government. The Oregon courts, applying this statute, found that the East German heirs could not inherit the personal property because the statutory conditions were not met. The application of the statute required the Oregon courts to investigate and pass judgment on the political and legal systems of East Germany, a Communist country. The heirs challenged the statute’s constitutionality, arguing it infringed on the federal government’s power to conduct foreign relations.
