Norman Vegors, an employee of Xenia Rural Water District, was injured when a coworker, Casey Byrd, struck him with a pickup truck. Immediately prior to the incident, Vegors, whose hands were full, gestured towards Byrd by wiggling his posterior. Vegors testified this was a common, non-serious form of greeting between them. After Vegors turned away and leaned over his own truck, Byrd attempted to bump him with his truck’s mirror as a prank but instead struck him with the truck bed, causing injury. Vegors sought workers’ compensation benefits. Xenia contested the claim, arguing Vegors was barred from recovery due to his participation in horseplay and asserting the affirmative defense under Iowa Code § 85.16(3) for willful injury by a third party for personal reasons.
