System Federation No. 40 (the Federation), a labor union, was certified by the National Mediation Board (NMB) as the exclusive bargaining representative for the shop craft employees of the Virginian Railway Company. The certification followed an NMB-supervised election in which the Federation defeated a company-dominated union that the railway had historically supported and funded. Despite the NMB’s certification, the railway refused to recognize or negotiate with the Federation. Instead, the railway continued to promote the company union and attempted to bargain with it, thereby interfering with the employees’ right to freely choose their representative under the Railway Labor Act (RLA). The Federation sought an injunction to compel the railway to comply with its duties under the RLA. The district court granted the injunction, ordering the railway to “treat with” the Federation and restraining it from interfering with its employees’ representational rights. The court of appeals affirmed, and the Supreme Court granted certiorari.
