The New York State Board of Elections promulgated a “Fair Campaign Code” pursuant to Election Law § 472(a). Plaintiffs, political candidates Roy Vanasco, Joseph Ferris, and Robert Postel, challenged specific Code sections: § 6201.1(c) (prohibiting attacks based on race, sex, religion, or ethnic background), § 6201.1(d) (prohibiting misrepresentation of candidate qualifications, including “personal vilification” and “scurrilous attacks”), § 6201.1(e) (prohibiting misrepresentation of a candidate’s position), and § 6201.1(f) (prohibiting misrepresentation of party affiliation or endorsement).
