A common owner, Bailey, owned three adjacent lots (4, 20, and 19). In 1904, she constructed a private sewer line running from her house on lot 4, across lots 20 and 19, to a public sewer main. This established a quasi-easement, with lots 19 and 20 serving lot 4. Bailey then conveyed lot 19 to Jones and lot 20 to Murphy via general warranty deeds that made no mention of the sewer. The lots were eventually sold to the current parties: Van Sandt (plaintiff) acquired lot 19, and Royster and Gray (defendants) acquired lots 20 and 4, respectively. The houses on all three lots connected to and used the private sewer. In 1936, Van Sandt’s basement flooded, leading him to discover the shared sewer line for the first time. At the time of his purchase, Van Sandt had inspected the property and knew it had modern plumbing that required a sewer connection, but he was unaware of the specific path of the drain across his land. He sued to enjoin the defendants from continuing to use the sewer.
