In 2004, Eldon Van Gundy (beneficiary) created an irrevocable trust, naming his son, Quinton Van Gundy (trustee), to manage it. The trust agreement granted the trustee broad powers, including the discretion to invest in various properties “whether or not such investments be of the character permissible for investments by fiduciaries under any applicable law, and without regard to the effect any such investment or reinvestment may have upon the diversity of the investments” (Section 8(d)). The trustee invested 100% of the trust’s brokerage account funds in common stocks and mutual funds, including some stocks purchased on margin. Despite a stated objective in 2007 to diversify so that only 30% of assets would be in stocks, the trustee maintained 100% in stocks until March 2009. After significant losses, the beneficiary sued for breach of contract. The trial court found the trustee breached his duty by purchasing stocks on margin and failing to diversify, applying the prudent investor rule. The trustee appealed these findings.
