Employee Benjamin Owens was discharged by his employer, Swift & Co., due to poor health related to high blood pressure. Owens contended he was medically fit for work and sought help from his union to secure reinstatement. The Union, as the exclusive bargaining agent, filed a grievance on Owens’s behalf pursuant to the collective bargaining agreement (CBA). The Union processed the grievance through the fourth step of the five-step procedure. To strengthen the case for arbitration, the Union sent Owens to a new doctor at its own expense. When this doctor’s report did not support Owens’s claim of fitness, the Union’s executive board concluded that arbitration would be fruitless and decided not to pursue the grievance further. Owens then sued the Union in Missouri state court, alleging it had breached its duty of fair representation (DFR) by arbitrarily refusing to take his meritorious grievance to arbitration. A jury returned a verdict for Owens, which was ultimately reinstated by the Missouri Supreme Court.
