In an 1859 treaty, the confederated tribes of the Yakima Nation ceded vast territories to the United States but reserved specific rights. Article III of the treaty secured to the tribes “the right of taking fish at all usual and accustomed places, in common with citizens of the Territory.” The respondents, Winans et al., subsequently acquired title to lands along the Columbia River through federal patents. They operated large, state-licensed fish wheels that effectively prevented the Yakima from accessing their traditional fishing grounds and depleted the fish supply. The respondents argued that their absolute title to the land and their state-issued licenses gave them the right to exclude the Indians. The United States brought suit on behalf of the Yakima Nation to enjoin this obstruction. The lower court dismissed the suit, holding that the treaty merely placed the Indians on an “equal footing” with other citizens, who would be subject to exclusion from private property.
