Defendant Russell Saadey, a former investigator for the Mahoning County Prosecutor’s Office, was involved in a widespread case-fixing scheme. After leaving his public position, Saadey attempted to solicit $16,000 from Kenneth Olsavsky, who was facing two DUI charges. Saadey told Olsavsky the money would be used to bribe Assistant Prosecutor James Vitullo to reduce the charges. Saadey was indicted for, among other things, RICO conspiracy (Count 1) and attempted extortion under color of official right in violation of the Hobbs Act (Count 8). The indictment for Count 8 alleged Saadey acted under the “pretense” that the money would be used to bribe Vitullo. The attempted solicitation of Olsavsky also served as a predicate act for the RICO conspiracy charge and was the only predicate act the jury found to have occurred within the five-year statute of limitations. At trial, the jury acquitted Vitullo, the public official, on all counts but convicted Saadey on the RICO and attempted extortion charges. Saadey appealed, arguing that as a private citizen, he could not be convicted of extortion under color of official right.
