A highly reliable confidential informant (CI), who had previously conducted several controlled drug buys from a dealer named Spaulding, informed Maine Drug Enforcement Agency (MDEA) Agent Deetjen that he would be driving Spaulding to Massachusetts to meet his cocaine supplier. Deetjen, who considered the CI the “best cooperating defendant I have worked with,” relayed this information and his assessment of the CI’s reliability to Agent Prough, a member of a Massachusetts-based DEA task force. MDEA and DEA agents conducted surveillance as the CI drove Spaulding to a restaurant parking lot in Massachusetts. During the drive, agents overheard Spaulding making incriminating statements about his drug source. In the parking lot, officers observed Spaulding make a phone call and then state, “the guy is on his way.” Shortly after, the defendant, Fiasconaro, arrived in a Honda. Spaulding entered Fiasconaro’s car for approximately 40 seconds, leaned between the front seats, and then quickly returned to the CI’s car. Based on these observations and the collective information, Agent Prough believed a drug transaction had occurred. He ordered local police to stop and arrest Fiasconaro. A search of Fiasconaro’s vehicle yielded $10,981 and a cell phone.
