Francis Dunmore and Percival Lowell were scientists employed in the radio section of the U.S. Bureau of Standards, engaged in general research and testing. Their assigned work involved projects such as “airplane radio.” On their own initiative and not as part of any specific assignment from a superior, they began experimenting with using alternating current (AC) from a standard house-lighting circuit to power radio receiving sets. This project was independent of their assigned tasks and was driven by their own scientific curiosity. They conducted this research during work hours, using government laboratory materials and facilities. After conceiving and perfecting the inventions, they disclosed them to their superiors, who permitted them to continue refining the devices. The employees filed for and obtained patents, which they later licensed to the Dubilier Condenser Corp. The United States sued, seeking an assignment of the patents, arguing that the inventions were its equitable property because they were developed by government employees in a government laboratory.
