After determining the valve check was unnecessary, they again chose to cross the pipe rack to return. While crossing, Allbritton slipped and was injured. The pipe rack was wet due to the firefighting efforts. Allbritton sued Union Pump under negligence and strict liability theories, arguing that but for the defective pump and resulting fire, she would not have been on the wet pipe rack and thus would not have been injured.
