Hernando Javier Vergara arrived in Tampa, Florida, on a cruise from Mexico. During a secondary inspection at the border, a U.S. Customs and Border Protection (CBP) officer manually searched Vergara’s Samsung phone and discovered a video of topless minors. This discovery prompted a special agent from the Department of Homeland Security to seize the Samsung phone and two other phones Vergara possessed. The agents then conducted off-site forensic examinations of the Samsung and an LG phone, which revealed over 100 images and videos of child pornography. No warrant was obtained for either the initial manual search or the subsequent forensic examinations. Vergara was indicted for transporting and possessing child pornography. He filed a motion to suppress the evidence, arguing the warrantless searches violated his Fourth Amendment rights under Riley v. California. The district court denied the motion, reasoning that Riley did not apply to border searches and that, in any event, the search was supported by reasonable suspicion. Vergara was convicted and appealed.
