The Drug Enforcement Administration (DEA) conducted a multi-year investigation into a drug trafficking organization allegedly run by Defendant Paymon. In March 2007, the DEA obtained a warrant to search two of Paymon’s residences, including his current apartment at Riverfront Towers. The supporting affidavit relied on information from several informants, much of which was years old. For example, one informant’s direct dealings with Paymon ended in the late 1990s. More recent information included a December 2006 tip about associates’ activities, surveillance of a different residence (Southfield) showing known drug offenders visiting, and Paymon’s illegal entry into Canada by boat in late 2006. The affidavit established Paymon had lived at the Riverfront Towers apartment since February 2006. However, it contained no informant information, surveillance evidence, or other facts directly linking any criminal activity to the Riverfront Towers apartment. The government argued a nexus existed because the apartment complex had a boat dock Paymon could have used. The search of the apartment uncovered a firearm, leading to a felon-in-possession charge. Paymon moved to suppress the evidence, arguing the warrant lacked probable cause due to staleness and a lack of nexus.
