The device enabled the government to learn the “to/from” addresses of Alba’s e-mail messages, the Internet Protocol (IP) addresses of the websites he visited, and the total volume of data transmitted to and from his account. The surveillance did not capture the content of his emails or the specific pages he viewed on any website. Alba was convicted and subsequently challenged the surveillance, arguing it constituted a warrantless search in violation of the Fourth Amendment. A co-defendant, Forrester, separately appealed his conviction on the grounds that his Sixth Amendment waiver of the right to counsel was not knowing and intelligent.
