Georgie Miriam Wait (testatrix) attempted to execute a will, with Sylvia Sunderland as the principal beneficiary and executrix. Sunderland had filled in parts of the will form at Wait’s request but was not present at the execution. Wait, old and feeble, asked two neighbors, Mrs. White and Mrs. Cunningham, to witness her will. During the attempt, Wait, struggling with a shaking hand, stated she could not sign then and would do so later, asking the witnesses to sign first. The witnesses signed in Wait’s presence and each other’s presence. They testified they could not confirm if Wait made any mark at that time, as she covered the signature line. Wait later informed Mrs. White she had successfully signed the will, which occurred a day or two after the witnesses attested and out of their presence.
