Defendants (Leonard et al.), building contractors, entered into a sealed written contract with plaintiffs to erect and complete a multi-story building on this land for a specified sum, providing all necessary materials and labor according to plans and specifications. After commencing construction, the building collapsed when it reached three stories high due to the soil being soft and yielding, resembling quicksand beneath the surface. Defendants rebuilt to the same height, and it collapsed again for the same reason. The soil’s latent defect was not apparent before excavation. Defendants contended they followed the specifications, which included ‘footings,’ and that the plaintiffs were responsible for ensuring the site was suitable or for draining the land.
