Defendant Joseph Mantelli, a uniformed police officer, shot and killed Abelino Montoya following a vehicle pursuit that ended at a dead-end street. The State’s primary witness, a passenger in Montoya’s truck, testified that Montoya was attempting to maneuver and flee when Mantelli broke the driver’s side window and fired as the truck drove away. In contrast, Mantelli testified that Montoya used the truck as a deadly weapon, ramming the police car. Mantelli claimed he fired because he believed his partner, Sgt. Marquez, had been knocked down and was in imminent danger of being run over. He testified he fired subsequent shots because he believed the truck was preparing to ram them again.
