The defendant, Deem, was indicted for felonious assault after repeatedly stabbing the victim. At trial, Deem sought a jury instruction on aggravated assault, arguing it was a lesser offense. To support this request, Deem presented evidence of a “historically stormy relationship” with the victim and an incident where the victim allegedly “bumped” his car with hers prior to the assault.
