Defendant John Siliznoff, a non-member of the plaintiff State Rubbish Collectors Association, secured a valuable rubbish collection contract previously held by an association member. The association demanded Siliznoff pay for the account. Over several meetings, association officials, including an inspector named Andikian, intimidated Siliznoff. Andikian explicitly threatened Siliznoff, stating that if he did not agree to the association’s terms, they would “beat you up,” either by hiring someone or doing it themselves. Andikian further threatened to “cut up the truck tires or burn the truck, or otherwise put me out of business completely.” The threats were of future, not immediate, harm. Believing the threats to be credible and fearing for his safety, Siliznoff agreed to sign promissory notes to pay for the account. As a direct result of the fear and distress caused by these threats, Siliznoff became physically ill, vomited, and was unable to work for several days. He cross-complained for damages based on this conduct.
