Case Brief Summary & Legal Analysis
tl;dr: The court redefined “physical force” for sexual assault, holding that the force inherent in non-consensual penetration is sufficient. This eliminated the need for additional violence or proof of the victim’s resistance, shifting the focus from the victim’s non-consent to the defendant’s unauthorized act.
Legal Significance: This case fundamentally shifted the legal standard for sexual assault in New Jersey from a traditional resistance-based model to an affirmative consent model. It defined “physical force” as any penetration occurring without the victim’s affirmative, freely-given permission, aligning sexual assault with principles of criminal battery.
Case Facts & Court Holding
Key Facts & Case Background
The juvenile, M.T.S. (17), and the victim, C.G. (15), were living in the same house. Their accounts of the incident differed, but the trial court found that while they had engaged in consensual kissing and heavy petting, C.G. had not consented to the subsequent act of sexual penetration. M.T.S. engaged in intercourse with C.G., who then slapped him and told him to get off, which he did. There was no evidence of threats, extrinsic violence, or force beyond that necessary to achieve penetration. M.T.S. was adjudicated delinquent for second-degree sexual assault. The Appellate Division reversed, holding that the sexual assault statute, N.J.S.A. 2C:14-2c(1), required a showing of physical force greater than that inherent in the act of penetration itself. The New Jersey Supreme Court granted certification to determine the meaning of “physical force” under the statute.
