Two separate lawsuits were filed against Bayer Corporation in West Virginia state courts over its drug Baycol. The first, brought by McCollins, was removed to federal court and consolidated into a multi-district litigation (MDL). The federal court, applying Federal Rule of Civil Procedure 23, denied McCollins’s motion to certify a class of West Virginia Baycol purchasers, finding that individual issues of injury predominated. McCollins did not appeal. The second lawsuit, brought by Smith, could not be removed to federal court due to a lack of complete diversity. After the McCollins decision, Smith prepared to move for class certification in state court under West Virginia Rule of Civil Procedure 23.
