Case Brief Summary & Legal Analysis

3 min read

tl;dr: A citizens’ group claimed a city’s use of ‘smart meters’ to collect detailed electricity data was an unconstitutional search. The court dismissed the claim, finding that allegations of what the city could do with the data were too speculative to constitute a Fourth Amendment violation.

Legal Significance: This case demonstrates that for a data collection program to constitute a Fourth Amendment search, a plaintiff must plausibly allege not just the technological capability for intrusion, but that the government is actually using the data to reveal intimate details of private life.

Case Facts & Court Holding

Key Facts & Case Background

The City of Naperville, a municipally-owned utility provider, began replacing traditional analog electricity meters with ‘smart meters’ as part of a grid modernization program. Unlike analog meters that recorded only total monthly consumption, the smart meters collected granular energy usage data in 15-minute intervals (‘Interval Data’). A citizens’ group, Naperville Smart Meter Awareness (NSMA), sued the City, alleging this practice constituted an unreasonable search under the Fourth Amendment. NSMA claimed that the detailed Interval Data could reveal intimate details of its members’ in-home activities, such as when they were home, asleep, or using specific appliances. In its proposed Third Amended Complaint, NSMA alleged that commercially available ‘energy disaggregation’ software made it possible for the City to analyze the Interval Data to conduct an intrusive search. The City offered residents an opt-out alternative: a ‘non-wireless’ meter that still collected the same Interval Data but was read manually, for a one-time fee and an additional monthly charge. After two prior dismissals, NSMA moved for leave to file its third amended complaint.

Court Holding & Legal Precedent

Issue: Does a government entity’s collection of granular, 15-minute interval energy usage data from residential smart meters constitute a search under the Fourth Amendment where the plaintiff alleges only the technological potential for intrusive analysis, rather than its actual occurrence?
