Appellee Heitner, a non-resident of Delaware, filed a shareholder derivative suit in Delaware against 28 non-resident officers and directors of Greyhound Corp., a Delaware corporation with its principal place of business in Arizona. The suit alleged that the defendants’ actions in Oregon caused Greyhound to incur substantial liability. To establish jurisdiction, Heitner utilized a Delaware statute that permitted the sequestration of any property of the defendants located in the state. Pursuant to this statute, the court seized the defendants’ Greyhound stock and stock options.
