John and Darlene Seigle (Plaintiffs) sought a bank loan to purchase a lot from the Jaspers-Tennills (Sellers) and pay off another. The lender, Peoples Bank, required a title examination and engaged its regular attorney, Robert Coots (Defendant), for the task. The Seigles agreed to use Coots and paid his fee as part of their closing costs. Coots performed title searches in 1979 and again for a refinancing in 1984 but failed to report a duly recorded pipeline easement held by Ashland Oil, Inc. The general warranty deeds from the sellers contained an exceptions clause for “easements and restrictions of record.” In 1988, Ashland Oil informed the Seigles that their structures encroached on the easement. The Seigles sued the sellers for breach of warranty and Coots for professional negligence. The trial court granted summary judgment for all defendants, finding no liability. The Seigles appealed the dismissals.
