Case Brief Summary & Legal Analysis
tl;dr: A husband fraudulently transferred community assets before filing for divorce. The Texas Supreme Court held that the wife could not sue him for the tort of fraud; her sole remedy is a disproportionate, or ‘just and right,’ division of the community estate in the divorce proceeding.
Legal Significance: This case establishes that in Texas, there is no independent tort cause of action between spouses for fraud on the community. The exclusive remedy for such a wrong is the trial court’s power to make a ‘just and right’ division of the marital estate.
Case Facts & Court Holding
Key Facts & Case Background
Richard and Karen Schlueter married in 1969. Shortly before filing for divorce in 1992, Richard engaged in transactions that depleted the community estate. He sold his interest in an emu business, a community asset worth at least $10,000, to his father for only $1,000. He also received a $30,360 early retirement check, which was community property, and gave it to his father, who retained over $12,500, purportedly to repay past loans. Karen was unaware of these transfers. Upon Richard’s filing for divorce, Karen counterclaimed and brought independent tort claims against Richard and his father for fraud, breach of fiduciary duty, and conspiracy. A jury found Richard committed fraud and awarded the community estate actual damages. It also awarded Karen exemplary damages against Richard. The trial court entered a judgment on the verdict and divided the marital property. The court of appeals affirmed, holding that an independent tort claim for fraud on the community exists between spouses. The Texas Supreme Court granted review to resolve a conflict among the courts of appeals.
